The Miskolc Symphony Orchestra Nonprofit Ltd. (hereinafter: "MSO") operates an online portal on the website www.mso.hu (hereinafter: Website), during which it manages the data of visitors and registered users (hereinafter: Users) of the Website. In connection with data management, MSO hereby informs Users about the personal data it manages on the Website, the principles and practices followed in the processing of personal data, and the rights and options available to the affected individuals to exercise their rights.

MSO respects the personal rights of the Users of the Website; the collected personal data is handled confidentially, in compliance with data protection laws and international recommendations, in accordance with the terms of this Data Management Policy.

MSO undertakes to ensure that all data management related to its activities complies with the expectations set out in this policy and the applicable legislation.

MSO informs the User that personal data provided in any way by Users during the use of various services available on the Website, participation in competitions, and registration (contests, games, promotions, surveys, puzzle competitions, etc.) will be entered into MSO’s records and managed by MSO as the data controller.

Legal Basis for Data Management

MSO’s data management is based on Section 5(1)(a) of Act CXII of 2011 on the right to informational self-determination and freedom of information (hereinafter: Infotv.), as well as Act CXIX of 1995 on the handling of name and address data for research and direct marketing purposes.

By using the Website, utilizing its services, registering, and voluntarily providing the relevant data, the User gives explicit consent to the recording and processing of their personal data by MSO. The User provides consent for each data processing activity by using the Website, registering, and voluntarily providing the requested data.

Types of Processed Data

During registration, Users are required to provide the following personal data:

  • Last name
  • First name
  • Email address
  • Password

After data submission, MSO will notify the User by email about the successful registration.

After registration, the User may voluntarily provide additional data, if necessary, for the completion or facilitation of the service provided by MSO.

Technical information is also recorded during browsing the Website (e.g., in log files containing the User's IP address, time of visit, and the URL of the page visited).

The system continuously logs these data but does not link them to the data provided during registration or use. MSO may record the data of the websites from which the User arrived at the Website, the websites visited on the Website, and the time and duration of the visit. This information is accessible only to MSO, not to the Users. MSO uses this data solely for the technical operation of the Website and for statistical purposes.

MSO places small data files (cookies) on the User’s computer during certain sections of the Website, which may contain the User's personal data. The User will not receive a separate notification from MSO about this. These data files are necessary for certain functionalities of the Website, and previous cookies are sent to MSO during visits.

The cookies cannot be used to identify the User and are valid only for the session. MSO uses cookies to deliver targeted information to visitors.

MSO uses the above information exclusively for the technical operation of the Website and for statistical purposes.

Data Management Duration

MSO’s data management begins with registration or subscribing to the newsletter and continues until the registration is deleted or the user unsubscribes from the newsletter.

In case of a request for registration deletion, MSO will delete the registration and personal data from the system within 2 business days from the receipt of the request.

If the User deletes their registration, their data will be automatically deleted from MSO’s system.

After deletion, the User's data will be permanently removed from MSO’s system and cannot be restored, requiring a new registration.

The logged data will be stored for 6 months from the logging date, except for the last visit date, which will be automatically overwritten.

Newsletter

MSO allows Users to subscribe to a newsletter after registration. The newsletter contains direct marketing elements and advertisements. MSO processes the data provided by the User during the newsletter subscription.

With the User’s prior consent, MSO may send newsletters about subscription offers and promotions.

MSO will only send advertising or promotional emails (newsletters) to the email addresses provided during registration with the explicit consent of the User, in accordance with the legal requirements, and when the User checks the "Subscribe to Newsletter" checkbox.

Scope of Persons with Access to the Data

The data can primarily be accessed by MSO and its internal staff, who are prohibited from disclosing or transferring it to third parties. They may only use the data for the purposes defined in the Data Management Policy.

For the operation of the underlying IT system, order fulfillment, and settlement, MSO may engage a data processor (e.g., system operator, accountant). MSO is not responsible for the data management practices of such external parties.

MSO takes all necessary steps to ensure the security of personal data provided by Users, both during network communication and data storage and retention.

User Rights and Legal Remedies

The User may request information about the handling of their data at any time free of charge, request the correction, immediate deletion, or blocking of their data from MSO, and object to the processing of their data.

The User is entitled to request information from MSO about their personal data being processed, and may modify them at any time in the manner specified in the Terms of Use.

MSO will provide information about the personal data it handles, the purpose of the data processing, its legal basis, duration, and the recipients of the data, within 30 days from the submission of the request.

The User may request the deletion, correction, or blocking of their data.

The User may request the correction or deletion of inaccurately recorded data using the contact details below. MSO will delete the data within 3 business days from the receipt of the request, and the data will not be recoverable. Deletion does not apply to data processing required by law (e.g., accounting regulations), which will be retained for the necessary period.

The User may also request the blocking of their data. MSO will block the data if the User requests it or if it is assumed that deletion would harm the User’s legitimate interests. Blocked data can only be processed as long as the data processing purpose that excluded deletion persists.

The User, as well as anyone who has previously received the data for data processing purposes, must be notified about the correction, blocking, or deletion. Notification may be omitted if it does not violate the User’s legitimate interests concerning the purpose of the data processing.

If MSO does not fulfill the User’s request for correction, blocking, or deletion, MSO will provide the reasons for the refusal in writing within 30 days of receiving the request.

The User may object to the processing of their personal data.

The User may object to the processing of their personal data. MSO will investigate the objection as soon as possible, but no later than within 15 days, and will inform the applicant in writing about the decision.

The User may contact the National Authority for Data Protection and Freedom of Information (1125 Budapest, Szilágyi Erzsébet fasor 22/c.; www.naih.hu) based on the Info.tv. and the Civil Code (Act IV of 1959).

The User may enforce their rights in court.

MSO reserves the right to modify these Terms of Use and Privacy Policy at any time unilaterally. The current version of the document is available to any visitor on the Website, and registered users will be notified by email about any changes when the modified document is published.
